In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation , hereinafter: Regulation) Margot Travel sp. z o.o. Sp. K., ul Królewska 39/1, 30–045 Kraków informs about the principles of personal data processing:

I. Data administrator

The administrator of your data is Margot Travel sp with its registered office in Kraków at ul. Królewska 39/1, 30-045 Kraków, entered into the register of entrepreneurs kept by the District Court for Kraków – Śródmieście in Kraków, 11th Commercial Division, under KRS number 0000396244, NIP 6772363585, REGON 122403309, tel. 48 12 429 56 78, email: biuro@margottravel.pl hereinafter referred to as „Margot Travel”.

II. Categories of personal data

Margot Travel processes the following categories of data: identification data, address data and contact details and data necessary for the purposes for which Margot Travel processes the data.

III. Purposes and legal basis for the processing of personal data

Personal data may be processed by Margot Travel for the following purposes:

  1. performing activities related to the current activities of Margot Travel, and in particular in order to take necessary actions related to the conclusion and performance of a contract with a client and to take actions by Margot Travel, at your request, before concluding the contract – the legal basis for the processing of personal data in this respect is art. 6 section 1 letter b Regulation,
  2. in the field of processing for statistical purposes and internal reporting – the legal basis for the processing of personal data in this respect is Art. 6 section 1 letter f Regulation,
  3. promotion and marketing of the activities conducted by Margot Travel during the term of the contract – the legal basis for the processing of personal data in this respect is the legitimate interest pursued by Margot Travel, i.e. Art. 6 section 1 letter f Regulation,
  4. promotion and marketing of the activities conducted by Margot Travel after termination, expiration or withdrawal from the contract – the legal basis for the processing of personal data in this respect is the consent of the data subject, i.e. Art. 6 section 1 letter a Regulation,
  5. establishing and pursuing one’s own claims or defending against submitted claims – the legal basis for the processing of personal data in this respect is the legitimate interest pursued by Margot Travel, i.e. Art. 6 section 1 letter f Regulation,
  6. fulfillment of legal obligations incumbent on Margot Travel in connection with running a business and in connection with the implementation of the contract – the legal basis for the processing of personal data in this respect is Art. 6 section 1 letter c Regulation,

IV. Information on personal data processing periods

Margot Travel will store your personal data:

  1. In connection with the conclusion of the contract and for its implementation – for the duration of the contract, and then for the period and to the extent required by law, as well as for the period necessary to establish and pursue own claims or defend against reported claims,
  2. for statistical and analytical purposes – for the duration of the obligation and for a period of 12 years from the expiry of the obligation,
  3. in the field of processing for statistical and internal reporting purposes – until the legally justified interest of Margot Travel constituting the basis for this processing is fulfilled or until you raise an objection,
  4. in the scope of promotion and marketing of the activities conducted by Margot Travel during the term of the contract – until you raise an objection,
  5. in the scope of promotion and marketing of the activities conducted by Margot Travel after termination, expiration or withdrawal from the contract – until you withdraw your consent,

in the scope of establishing and pursuing their own claims or defending against reported claims – until the limitation period for potential claims arising from the contract or otherwise, in the scope of fulfilling the legal obligations incumbent on Margot Travel – for the period in which the law requires entrepreneurs to store documentation and fulfill obligations regarding your obligations arising therefrom,

V. Information about recipients of personal data

The data is intended for Margot Travel and may be transferred to the following recipients:

  1. entities and bodies to which Margot Travel is obliged or authorized to provide personal data on the basis of generally applicable legal provisions, including entities or bodies authorized to receive personal data from Margot Travel or entitled to request access to personal data on the basis of generally applicable legal provisions,
  2. entities participating in processes necessary to perform contracts concluded with the data subject,
  3. entities processing personal data of the data subject on behalf of Margot Travel on the basis of an agreement concluded with Margot Travel for entrusting the processing of personal data,
  4. entities supporting Margot Travel in business processes and activities of Margot Travel.

VI. Automated decision-making, including profiling

Profiling should be understood as any form of automated processing of personal data, which consists in using personal data to evaluate certain characteristics of a natural person, in particular to analyze or predict aspects relating to that natural person’s work, economic situation, health, personal preferences, interests, reliability, behavior, location or movement. Margot Travel does not process personal data in the above-mentioned manner.

VII. Rights of the data subject

You have the right to access your personal data, the right to request its rectification, deletion and limitation of processing under the conditions arising from the Regulation. To the extent that the basis for the processing of your personal data is the legitimate interest of Margot Travel, you have the right to object to the processing of your personal data.

To the extent that the basis for the processing of your personal data is consent, you have the right to withdraw consent. Withdrawal of consent does not affect the compliance of processing carried out on the basis of consent before its withdrawal.

To the extent that your personal data is processed for the purpose of concluding and performing a contract or processed on the basis of consent – you also have the right to transfer personal data, i.e. the right to receive your personal data from Margot Travel, in a structured, commonly used, machine-readable format (you can send this data to another data controller). To the extent that your personal data is processed for the purposes of promoting and marketing the business run by Margot Travel – you have the right to object at any time to the processing of your data for the purposes of promoting and marketing the business run by Margot Travel, including profiling, to the extent that processing is related to the promotion and marketing of the activities conducted by Margot Travel.

You also have the right to lodge a complaint with the body supervising compliance with the Regulation of the President of the Personal Data Protection Office if there is a suspicion that the processing of your personal data violates the provisions on personal data protection.

VIII. Source of data

The information concerns personal data obtained in a way other than from the data subject. Your data may come from the principal (in the case of a power of attorney granted), the statutory representative, as well as publicly available sources (e.g. databases and registers: REGON, Central Register of Economic Activity (CEIDG), National Court Register) and persons/entities having the basis to share your data.

IX. Transfer of personal data to a third country

Margot Travel, in justified and necessary cases, in order to perform the contract (e.g. implementation of your instructions related to the contract), and also in cases where the transfer of personal data is necessary, will transfer your personal data to international organizations (e.g. SWIFT) or you will share your personal data with entities based outside the European Economic Area (EEA).

Due to the fact that Margot Travel provides services in the organization of tourist events, it must provide personal data in order to fulfill your orders and needs.

X. Obligation to provide personal data

Providing your personal data is voluntary, however, it is a condition for concluding and implementing the contract and legally defined rights and obligations of Margot Travel. In the event of failure to provide personal data, Margot Travel is forced to refuse to conclude the contract.

To the extent that personal data is collected on the basis of your consent, providing personal data is voluntary.

XI. Security of data processing

In order to avoid unauthorized or inappropriate use of personal data managed by Margot Travel, the company has undertaken comprehensive technical and operational security measures. Security procedures are regularly reviewed and improved in line with technological progress.
