Personal Data Protection

Dear User, please read thoroughly the following information:

 

In view of the execution of the requirements of the General Data Protection Regulation of the European Parliament and Council (EU) 2016/679 on data protection of individuals with regard to personal data processing and on free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as: the Regulation) Margot Travel sp. z o.o. Sp. K., ul Królewska 39/1, 30–045 Kraków informs about the rules of personal data processing:

 

I. Data Controller

Your data controller is Margot Travel sp. z o.o. S.K. with its registered office in Kraków, at Królewska 39/1, 30-045 Kraków, entered to the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register (KRS) under the number 0000396244, Tax Identification Number (NIP) 6772363585, REGON number 122403309, phone number: +48 12 429 56 78, email: biuro@margottravel.pl, hereinafter called “Margot Travel”.

 

II. Categories of Personal Data

Margot Travel processes the following categories of data: identification data, address data, and contact data as well as the data necessary for the purposes of processing data by Margot Travel.

 

III. Objectives and legal basis for personal data processing

Personal data can be processed by Margot Travel for the following purposes:

  1. executing actions connected with current activities of Margot Travel, especially to take necessary steps to conclude and execute an agreement with a customer and to perform actions by Margot Travel on your request before concluding the agreement — the legal basis for personal data processing in this area is Art. 6 Section 1b of the Regulation,
  2. processing for statistical purposes and for internal reporting – the legal basis for personal data processing in this area is Art. 6 Section 1f of the Regulation,
  3. promotion and marketing of the activities run by Margot Travel during the duration of the agreement – the legal basis for personal data processing in this area is legitimate interest pursued by Margot Travel, i.e. Art. 6 Section 1f of the Regulation,
  4. promotion and marketing of the activities run by Margot Travel after termination, expiration or withdrawal from the agreement – the legal basis for personal data processing in this area is the consent of the data subject, i.e. Art. 6 Section 1a of the Regulation,
  5. establishing claims and redress or defence against claims – the legal basis for personal data processing in this area is legitimate interest pursued by Margot Travel, i.e. Art. 6 Section 1f of the Regulation,
  6. complying with legal obligations assumed by Margot Travel resulting from the business activity and implementation of the agreement – the legal basis for personal data processing in this area is Art. 6 Section 1c of the Regulation.

 

IV. Information about the periods of personal data processing

Margot Travel shall store your personal data:

  1. related to the conclusion of the agreement and for the purposes of its implementation, for the duration of the agreement, and then for a period and to the extent required by law, as well as for a period necessary to establish and pursue claims and defend against claims,
  2. for statistical purposes and analyses – for the duration of the obligation and for 12 years from the date of the obligation expiry,
  3. for processing for statistical purposes and internal reporting – until legitimate interest of Margot Travel, being the basis for this processing, has been fulfilled or until you have objected to it,
  4. for promotion and marketing of the activities run by Margot Travel during the duration of the agreement – until you have objected to it,
  5. for promotion and marketing of the activities run by Margot Travel after termination, expiration or withdrawal from the agreement – until you have withdrawn your consent,

for establishing and pursuing claims or for defence against claims – until the limitation of potential claims resulting from the agreement or due to other reasons, for complying with the legal obligations assumed by Margot Travel – for a period in which the law obliges entrepreneurs to store documentation and fulfil obligations to you resulting from it.

 

V. Information about the recipients of personal data

The data is intended for Margot Travel and can be transferred to the following recipients:

  1. entities and authorities with which Margot Travel is obliged or authorised to share personal data based on universally binding provisions of law, including entities or authorities entitled to receive personal data from Margot Travel or entitled to demand access to personal data based on universally binding provisions of law,
  2. entities participating in processes necessary to execute agreements with the data subject,
  3. entities processing the personal data of the data subject on behalf of Margot Travel according to a personal data processing outsourcing agreement concluded with Margot Travel,
  4. entities supporting Margot Travel in business processes and in the activities of Margot Travel.

 

VI. Automated decision-making, including profiling

Profiling should be understood as any form of automated personal data processing which is based on using personal data for the assessment of some features of an individual, especially for the analysis or prognosis of aspects concerning this individual’s work, his/her economic situation, health, personal preferences, interests, credibility, behaviour, location or movement. Margot Travel does not process personal data in the above mentioned way.

 

VII. The rights of the data subject

You have the right to access your personal data, the right to demand its correction, removal, limitation of processing on the conditions resulting from the Regulation. To the extent that the basis for processing your personal data is the condition of a legitimate interest of Margot Travel, you have the right to object to processing your personal data.

To the extent that the basis of your personal data processing is your consent, you have the right to withdraw the consent. Withdrawing the consent does not affect the processing which was performed before the consent withdrawal.

To the extent that your personal data is processed to conclude and implement the agreement or is processed based on the consent, you also have the right to transfer personal data, i.e. the right to receive from Margot Travel your personal data in a structured, commonly used format, in a machine-readable form (you can send the data to another data controller). To the extent that your personal data is processed for promotion and marketing of the activities performed by Margot Travel, you have the right to object at any time to your data processing for the purposes of promotion and marketing of the activities performed by Margot Travel, including profiling, to the extent in which the processing is connected with promotion and marketing of the activities performed by Margot Travel.

You have the right to lodge a complaint with an authority supervising the compliance with the Regulation, the President of the Personal Data Protection Office, if there is a suspicion that your personal data processing violates the provisions on the personal data protection.

 

VIII. Data source

The information relates to personal data acquired by means other than from the data subject. Your data may come from a principal (if a power of attorney has been granted), a statutory representative or commonly accessible sources (e.g. databases and registers: REGON, Business Activity Central Register and Information Record (CEIDG), National Court Register) and people/entities having grounds to share your data.

 

IX. The transfer of personal data to a third country

In justified and necessary cases, to implement the agreement (e.g. to meet your requests connected with the agreement), and in cases where personal data transfer is necessary, Margot Travel will transfer your personal data to international organisations (e.g. SWIFT) or will share your personal data with entities residing outside the European Economic Area (EEA).

As Margot Travel provides tourist event organisation services, it has to transfer personal data to execute your orders and demands.
 

X. Obligation to provide personal data

Providing your personal data is voluntary, however it is indispensable to conclude and implement the agreement and statutory rights and obligations of Margot Travel. If personal data has not been provided, Margot Travel will have to refuse to conclude the agreement.

If the processing of your personal data is based on your consent, you provide the personal data voluntarily. 

 

XI. Security of data processing

In order to avoid unauthorised or inappropriate use of personal data managed by Margot Travel, the company has taken complex operational and technical safety measures. Safety procedures are regularly checked and improved in line with technological progress.
